Re: Ryanair in 2018
For all complaints regarding cancelled flights and delayed flights, Ryanair's news clause is an obvious infract against Article 15 from EU-Rule 261/2004:
For claims not related to EU-Rule 261/2004 (example: conflicts about luggage), the Belgian legislation WMPC applies (= "wet van 6 april 2010 betreffende marktpraktijken en consumentenbescherming"). And that legislation also forbits what Ryanair is doing with this new clause:Article 15: Exclusion of waiver
1. Obligations vis-à-vis passengers pursuant to this Regulation may not be limited or waived, notably by a derogation or restrictive clause in the contract of carriage.
2. If, nevertheless, such a derogation or restrictive clause is applied in respect of a passenger, or if the passenger is not correctly informed of his rights and for that reason has accepted compensation which is inferior to that provided for in this Regulation, the passenger shall still be entitled to take the necessary proceedings before the competent courts or bodies in order to obtain additional compensation.
Conclusion: with this new illegal clause, Ryanair will convince 99% of passengers with a valid claim to drop it. Just like they do with their refusal to reschedule passengers for cancelled flights: perhaps 1% from those passengers will ask legal advise. All others think they can't go to court for 19,99 € (whilst actually, they could ask a court for reimbursement of the cancelled FR-flight ànd the cost from the ticket with a new carrier ànd other costs like additional hotel accommodation)....
(het is verboden...)

Re: Ryanair in 2018
Ryanair, Europe’s today (4 Oct) welcomed the Commercial Court of Barcelona’s recent ruling confirming that no EU261 compensation is due to customers whose flights are cancelled because of internal strike action, as such strikes are beyond the airline’s control.
Ryanair fully complies with all EU261 legislation and has re-accommodated or refunded all customers affected by the small number of strike cancellations, and provided full assistance to customers where needed, including accommodation, meals and rerouting.
However, as these cancellations are beyond Ryanair’s control, no EU261 compensation payments are due, as confirmed by this Barcelona court ruling, the ninth such recent Spanish court ruling, following similar decisions in the Courts of Badajoz, Ourense and Pontevedra.

Barcelona court rules that Ryanair does not have to pay EU261 compensation for internal strikes. This goes against a ruling by a German court.Boeing767copilot wrote: ↑04 Oct 2018, 13:56 Ryanair, Europe’s today (4 Oct) welcomed the Commercial Court of Barcelona’s recent ruling confirming that no EU261 compensation is due to customers whose flights are cancelled because of internal strike action, as such strikes are beyond the airline’s control.

Hang on a second, isn’t Ryanair usually the one to claim that no matter what, only Irish courts are competent in these matters, or do I remember that incorrectly?
If not, then what has changed?
It seems like they like to change with the wind, whenever it suits them.
Nothing new there, of course.

Indeed. Not all local courts follow EU-Court decisions. Specially the basic courts in the Netherlands, where bird strikes are often not seen as "extraordinary circumstance": aircraft manufacturers have issued standard guidelines what to do then, so it's part of normal flight operations, one particular Dutch court (kantonrechtbank) uses to rule.sn26567 wrote: ↑04 Oct 2018, 14:17Barcelona court rules that Ryanair does not have to pay EU261 compensation for internal strikes. Comment: in a similar case involving TUI fly, a German court had rules that TUI had to pay EU261 compensation, because an internal strike was within its control.
European courts should sing the same song! Lawyers have beautiful days ahead.

Ryanair to launch six new routes from Belgian airports (from Summer 2019) – Michael O’Leary reaches out to Belgian unions

Re: Ryanair in 2018
Next to the announcement of new routes, Michael O’Leary urged the Belgian unions to get moving in order to get an agreement done. “We want to grow in Belgium, we invite the unions to sit together and discuss on a collective labour agreement,” the CEO said. Only a few weeks ago, O’Leary wanted to change to the Belgian law on 1 March 2020 only, giving the time to make a smooth transition between Irish legislation and Belgian legislation. But today O’Leary said that he wants the local Belgian law to apply “from 1 January 2019, even earlier if possible.”“We want to reach an agreement with the Belgian unions as soon as possible“
From 1 March 2020 ( https://www.aviation24.be/airlines/ryan ... on-friday/ )
to 1 January 2019 ( https://www.aviation24.be/airlines/ryan ... an-unions/ )
In a few weeks time ...

Belgian unions told Belgian VRT they have not heard back from Ryanair, despite sending a pre-text on a collective labour agreement three weeks ago.

Today he wants to expand and talk to the trade unions.
Is he trying to mitigate the problems Ryanair is having...

Could be true, could be staged:
Re: Ryanair in 2018
I read that, definitely staged (*). Already tried lying on the floor? I can't, not even for one hour. Looking at the recent tensions between them and their management I understand the picture though.
Users on social media are questioning the explanation by COO Peter Bellew, he simply said that no hotels were available at Malaga Airport. I don't believe that, you have the entire Costa del Sol build full of hotels.
The entire story is that 6 Ryanair flights destination Porto diverted to Malaga, Ryanair is talking about 'some flights'. Most of the 800 passengers reacted furiously as - next to the lack of water and food - no information was provided during the night. My article: https://www.aviation24.be/airlines/ryan ... a-airport/
