The US Senate unanimously passed a bill on Saturday that would shield U.S. airlines from paying for their carbon emissions on European flights, pressuring the European Union to back down from applying its emissions law to foreign carriers.
The European Commission has been enforcing its law since January to make all airlines take part in its Emissions Trading Scheme to combat global warming, prompting threats of a trade fight.
Republican Senator John Thune, a sponsor of the measure, said it sent a "strong message" to the EU that it cannot impose taxes on the United States.

If European airlines pay the tax and US don't then competition is distorted. US should learn they cannot impose unilaterally their will to the rest of the world.

A country is the owner of the airspace above and the soil underneath. So they can tax anyone to use the airspace above their territory. As they can forbid any plane to enter their owned airspace (see blacklist). I think one of the problems US has is that the tax is not only for EU airspace but for the whole trip in and out EU airspace

No they want those Americans to pay an American tax instead. If they would pay the EU tax, then the USA would have a harder time making them pay another one.

In case of the latter, it will form yet another competitive disadvantage to the EU intercontinental airlines, in case it isn't, i bet there are quite a few of them which will suddenly be able to book significantly better results as they had already budgetted a certain amount of money to pay for these emission rights.

All airlines flying intercontinental routes to/from Europe will be exempt, at least until November 2013, in the hope that by that date ICAO will come up with a global scheme. For equity reasons, international airlines flying intra-European segments should be submitted to the tax when transporting intra-European passengers.
Airbus is happy, and so is IATA. Lufthansa however complains (rightly) that intra-European feeder flights submitted to the tax will cause a competitive disadvantage versus airlines flying directly to/from Europe.
