Post by TLspotting »

Good evening everyone,

This decision is due to Lufthansa, that didn't buy Niki.

Lufthansa wanted to buy Niki. More exactly, the decision is due to the European Commission, which forbad Lufthansa to purchase Niki.

Passengers with Niki flights included in a travel package will be assisted/rerouted by that t/o.

Passengers with only a ticket, paid by a credit card, can file a chargeback request with their credit card issuer. Usually, the local bank will assist.

Passengers with only a ticket, paid by a bank transfer, have lost their money. They could file a request with the liquidator, but the chances that they will be refunded, is close to 0%.

Maybe some other carrier will soon offer a special fare "Niki rescue" for holders of a useless ticket.

Why doesn't LH try to acquire Niki via one of its foreign subsidiary airlines? I think that wouldn't violate the EU competition law.

He's not interested. His marketing department told him to send out a press release, stating that he's interested. Reason: the Ryanair shareholders need some good news, after the trade union debackle.

Even if legally possible, that will not give LHG the goodwill they need from the EU to get the rest of the deal approved. From the beginning it was clear that Niki was a nice to have, but the most likely to be given up if the EU started to doubt.

Senior aviation & travel journalist Jan Peeters (Travel360) blames the EU: "...If you are playing a poker game and you look around the table and you can’t see who the sucker is, it’s you...” (Paul Newman)

NIKI founder Niki Lauda is still interested in buying back the airline, but said it would need a fresh start on the basis of insolvency proceedings.

Thomas Cook (UK) is also considering a takeover of NIKI, after the latter was left looking for a new investor following Lufthansa decision to drop a bid.

Austria is holding “very good” discussions about providing a bridge loan to NIKI, which filed for insolvency protection.

Air Berlin receiver Lucas Floether says he is optimistic about the NIKI sales process after a number of would-be investors stepped forward under a fast-approaching deadline.

And indeed, NIKI founder Niki Lauda intends to bid for the airline on 20 December 2017, adding he will engage in the talks initially without Thomas Cook (UK) in order to speed things up. Also bidding for some NIKI assets – including NIKI Technik, and crews – are Zeitfracht (Germany) and Nayak (Germany).

NIKI is allowed to keep its airport slots while the Austrian Ministry of Transport explores a bankruptcy filing.

PrivatAir (Switzerland) made a bid for NIKI, raising the number of interested parties to five.

Is Niki Lauda himself bidding together with Thomas Cook UK or are they bidding alone?
