Air Berlin may be bankrupt, but it has now fully paid back its entire €150 million loan to the federal government of Germany.

Air Berlin insolvency administrator had its appeal dismissed by a London court, thus concluding its fight with Etihad over a US$416 million loan arrangement should be heard in England.

The Air Berlin insolvency administrator suffered a setback in its dispute with Etihad, as Germany’s Federal Court of Justice dismissed a complaint raised by Air Berlin. The rejection is likely to have far-reaching consequences in relation to the question of whether Etihad can be held liable.

Air Berlin administrator Lucas Flother says there is no end in sight to the insolvency proceedings as it will last five to ten years.

Lufthansa and easyJet gained backing from Europe’s second top court for their acquisitions of insolvent Air Berlin assets four years ago. In another deal, easyJet secured unconditional clearance from the EU competition enforcer for the €40 million deal in 2017.

Air Berlin insolvency administrator Lucas Flother is no longer demanding compensation from the airline’s former major shareholder, Etihad, as the process would have to be conducted in the UK.

Air Berlin former workers in Palma applaud the decision of the Mercantile Court to submit to the EU several questions for a preliminary ruling due to the bankruptcy of the branch in Spain. They expect €1 million to be returned.
