Noise restrictions at Brussels Airport: the Council of State rejects the airport’s appeal

By a verdict from 10th Nov 2016, the Council of State (Belgian supreme court for legal matters against a public authority) has waived the appeal from Brussels Airport against the latest noise restrictions imposed by the Brussels Capital Region. Reason given: “Brussels Airport hasn’t proven that they have an own and legal interest in the matter“. The complaint by Brussels Airport has thus been declared not acceptable. Overschrijding geluidsnormen door vliegtuigen niet langer getolereerd in Brussel
De vordering tot schorsing van de tenuitvoerlegging van de beslissing van de bevoegde minister van de Regering van het Brussels Hoofdstedelijk Gewest en van het Brussels Instituut voor Milieubeheer “tot opheffing van de tolerantie met betrekking tot de vaststelling van inbreuken op het besluit van de Brusselse Hoofdstedelijke Regering van 27 mei 1999 betreffende de bestrijding van geluidshinder voortgebracht door luchtverkeer” werd verworpen bij arrest nr. 236.402 van 10 november 2016 omdat de verzoekende partij geen wettig belang heeft aangetoond.

La demande de suspension de l’exécution de la décision du ministre compétent du Gouvernement de la Région de Bruxelles-Capitale et de l’Institut bruxellois pour la gestion de l’environnement “supprimant la tolérance en matière de constat des infractions à l’arrêté du Gouvernement de la Région de Bruxelles-Capitale du 27 mai 1999 relatif à la lutte contre le bruit généré par le trafic aérien” a été rejetée par l’arrêt n° 236.402 du 10 novembre 2016, au motif que la partie requérante ne justifie pas d’un intérêt légitime.
