The US Court of Appeals for the Eleventh Circuit has ruled in favour of Aeromexico and Delta Air Lines, overturning a Department of Transportation order that would have terminated approval and antitrust immunity for their transborder joint venture.
As a result, the partnership and its antitrust immunity remain in effect. The two airlines can therefore continue coordinating their networks and services between Mexico and the United States.
Aeromexico said the agreement provides passengers with broader connectivity, more travel options and increased competition in the US–Mexico market.
The airline is reviewing the court’s opinion with Delta and its legal advisers before deciding on any further action.
